1. Introduction
The Kenya Land Alliance (KLA) was registered in 2000 as a Trust and in 2013 as NonGovernmental Organization (NGO). It operates as an umbrella network of Civil Society Organizations (CSOs) and individuals committed to effectively advocating for reforms of policies and laws governing land, environment and natural resources in Kenya. Its current membership comprises of 27 Non Governmental Organizations, 31 Community Based Organizations and 52 individuals. KLA executes its mandate mainly through coalition building, advocacy and lobbying, information generation, documentation and dissemination, networking and capacity building.
Since its formation, KLA has advocated for reforms to help address the myriad of challenges facing the land sector. Its work has contributed to the adoption of the first ever National
Land Policy in 2009 and a progressive chapter in the 2010 Constitution dealing with land and environmental matters. In addition, KLA has engaged in most land processes, task forces and discussions in the country.
2. Background
Kenya has made great strides towards realization of land and natural resources rights in Kenya with recent legal framework and policy reviews. More specifically, there are various legislations and policies which anchor an enabling environment for the advancement of Women’s Right to Land. Key among these include the National land policy,2009; Land registration Act (2012); Land Act (2012); National land commission Act (2012 );Matrimonial property Act (2013); Marriage Act (2014); Community land Act (2016); and the Constitution of Kenya (2010). Other legislations include Law of Succession chapter 16 of the laws of Kenya and the National Policy on Gender and Development sessional paper N0.2 of
2019.
The Constitution of Kenya (2010) outlaws discrimination on the bases of sex, marital status, ethnicity or social origin, age, disability, religion, belief, culture, among others. To realize
these ideals, the Constitution; Article 27 (6) requires that progressive legislative and other measures should be promoted – including affirmative action – to redress disadvantages suffered by individuals and groups because of past discrimination and to ensure that no more than two thirds of the members of elective or appointive bodies are of the same
gender (Article 27 (8).
Notably, the principles contained in the NLP, 2009- which was adopted before the promulgation of the 2010, Constitution- informs most of the aforementioned legislations
including Chapter 5 of the Kenyan Constitution. The NLP, 2009, was formulated to address critical issues of land administration, access to land, land use planning, restitution of historical injustices, environmental degradation, conflicts, unplanned proliferation of informal urban settlements, outdated legal framework, institutional framework and information management. It also addresses constitutional issues, such as compulsory acquisition and development control as well as tenure issues. Section 10 of the NLP, 2009,  provides that a review of the policy should be undertaken after 10 years taking into account the social economic dynamics in the land sector. This ten-year period lapsed in 2019.
The review of the NLP, 2009, which has since been highlighted as a priority area in the Ministry of Lands and Physical Planning’s strategic plan, provides an opportunity for
Women’s Land Rights actors to review the policy and ensure that the progressive policy aligns to the CoK, 2010.

It is against this backdrop that Kenya Land Alliance seeks to commission an analysis of the NLP, 2009 from a gender lens to ensure that the policy is engendered in the long run.

3. Purpose
The purpose of this assignment is to undertake a comprehensive gender analysis of the National Land Policy 2009 and provide policy recommendations from a gender lens with a view of aligning the revised policy with the CoK, 2010.
4. Planned Outcome
A comprehensive compendium and clear policy recommendations from a gender lens for the NLP technical working group.
5. Planned Output
The consultant will be expected to;
● Conduct a desktop review on the National Land Policy 2009, its implementation, gains and challenges from a women’s land rights perspective.
● Harmonize the policy recommendations from the analysis and those made by Women’s Land Rights actors onto the primary policy working paper for the taskforce.

6. Key deliverables
The consultant will work closely with Kenya Land Alliance designated staff. All deliverables
shall be submitted in English and virtually to the stakeholders. The consultant should
submit following key deliverables,
● Inception report: Outlining details of activities with proposed methodology and timeline/ delivery dates,
● Draft analysis with recommendations for validation,
● A final compendium of not more than 10 pages with clear policy recommendations.

7. Skills and Competencies
The Kenya Land Alliance is looking for a consultant with the following competencies:
• At least a Masters Degree or equivalent in law, social sciences, gender studies or related discipline.
• At least 8 years’ experience in developing gender policies, audits, analyses in the land sector or related field.
• Thorough understanding of gender equality issues and best practices related to addressing gender equality issues, especially as that which pertain to women’s land rights.
• Knowledge and understanding of the national level institutional, legal and policy frameworks impacting the status of women’s rights to land and natural resources.
• Outstanding data collection, research and writing skills: ability to review, edit and synthesize reports, analyze data, articulate results and produce high quality reports.
• Strong communication and presentation skills.
• Ability to work both as part of a team and independently

Qualified Consultants are invited to submit a proposal that includes the following:
A brief description of the consultant’s recent experience on comparable assignments;
● Technical understanding or interpretation on the terms of reference;
● A description of services and work plan for performing the assignment, including
budget;
● Recent CV of consultant/s.
